Hi everyone, I bought 3 CDs from the same seller and 05/12/10 and paid for them together on 09/12/10. I have not received them. I realise with the weather the post is being held up so I waited longer than I usually would to contact the seller. A few days ago I received a huge amount of post from different sellers which had obviously been building up and was delivered in one go, but the CDs were not there. So I then contacted the seller asking for more information. He provided me with a Royal Mail tracking number, when entered into Track & Trace it says the package was posted on the 10th and is in transit. I keep checking back in it just says the same thing. I've been to the local sorting office recently to pick up something that couldn't be delivered as no one was in and asked there but they said they had no more packages for me. My family and my neighbours rarely take packages for eachother but my Dad has even asked them but they have not seen it. Even if it had been left with someone else it would have been signed for, and a card would have been left. So I emailed the seller again and he basically said there was nothing he could do, he has proof it has been posted and it is up to the Royal Mail to deliver it and if it doesn't arrive then it is my responsibility to claim from the Royal Mail. Is this true? Does it really have nothing to do with the seller anymore?

Put in a paypal claim for item not received, they won't be agreeing with his viewpoint.
(They take the view it's nothing to do with the buyer)

As seller has already refused a refund just log into paypal now and open an item not received item against the payment you made. Read the various options carefuilly and don't let paypal divert you back to ebay.
Then after 10 days if seller cannot prove delivery the refund goes through without his consent.

The seller didn't technically refuse a refund, I never actually asked for one. But he never offered either, just said it wasn't his responsibility, which I didn't think was right. He has a good feedback score (428), and I've never known a seller to completely refuse responsibility. Should I contact him again to ask for a refund before filing the dispute?0

Regardless of what the seller says, you cannot claim from RM as you have no contract with them on this item. He bought the service from RM so he must make the claim. It is insured for up to £41 so he will eventually get the value up to this limit. If it is worth more than this then the extra is his loss.

I did not receive an item bought on eBay and sent by Royal Mail Track and Trace on 24 November. The RM website stated that it could not be tracked until it had been delivered. The seller would not accept that I had not received it and kept telling me to contact the delivery office. I had no option other than raise a Dispute Case with eBay. When I did he refunded my money the same day. As he was covered up to £41 and the item cost £38 he was not out of pocket.To Dare is To Do:beer:0
