Redundancy after Maternity Leave

Hi
My wife is being made redundant with effect from 31-03-2011, but is due to return to work 07-03-2011 from maternity leave. She is due 12 weeks notice (due to service). therefore would her notice be minus 12 weeks from 31-03-2011 (w.c 03-01-2011) or 12 weeks from 07-03-2011? If its the latter then does she return to work for 3 weeks and then get paid 9 weeks notice ?
Sorry for all the questions however its getting complicated !

I take it you know she is being made redundant because she has (just) been given notice. So the notice starts from when she was notified. As it is at least 12 weeks before her last date of service it is valid.
If she returns to work on 7-3-11, then she will be on full pay from that date to 31-3-11 and from now until 7-3-11 will be on whatever maternity pay she is entitled to.
Check her annual leave, there may be some owing. Calculating how much depends on her conmpany's policy on leave entitlement during maternity leave, her exact leave year and any statutory entitlement.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. holidays acrue durring maternity and carry over a holiday year.0

If the redundancy is immediate, why would she go back? After all there is no job to go back to.
As correctly stated, holiday accrues until the expiry of the maternity leave and should be paid at the expiry.0 -
What happens in this situation to any work place maternity pay? For instance in the NHS you get 8 weeks at the equivalent income rate as full pay and then the next 18 weeks at half pay plus SMP. All of this is conditional on returning to work after your maternity leave. If you are made redundant then you are not returning at the end of your maternity leave.0

they will probley pay her up so she dont have to return0

The company still have to pay all the maternity pay she is contractually entitled too if they make you redundant at any time after 17 weeks pregnant! So they will have to pay her the full maternity and her notice period (If they want her to work her notice or not thats up to them).
