Paypal are taking the P

I made a claim against Senditquick.com for late delivery and damaging a table they were transporting, they ignored my e-mails after I filed a claim with them and failed to contact me after 6 weeks, according to their online compensation form they will get back to me withing 28 days.

I then tried to get at least my delivery fees back from them through PayPal. after 7 days without a reply I escalated it to a claim, 5 seconds after I submitted the claim I received an automated e-mail from PayPal saying that after investigating my claim they had decided to decline..after 5 seconds!

So is this the end?, is there anthing else I can do?

    A friend was in a similar position where paypal investigated and found in favour of the seller in a situation where it was clear that the seller was in the wrong and literally even an idiot would have found in my mates favour, his next course of action was to complain about the decision you can't appeal if you are the buyer apparently, but complaining seems to result in the same thing) and the next day it was re-opened. If this fails you can complain about it to the financial ombudsman service. If anyone is curious, the situation with my friend was one where the item being sold was advertised as one thing, and then, included in the listing in a foreign language was a comment that you had to pay 15% higher for the advertised article than the end price or you would get the same product with their branding on it instead (the manfacturer of these products neither sells unbranded products or prints other company branding on the product so this is not true) and when the item came it was their own one(although he bought various similar items, some came as their branding, some the genuine article. In their Buy it now shop they have both the branded and genuine items for sale, their own branded one half the cost of the other but they mislead buyers into paying double the going rate for their own product by tricking people with this 15% rule. He also submitted a report from the UK distributor of the product who had inspected them and said they were in no way the genuine article with merely a personalised branding but paypal seem to have ignored all this...not sure if it's just coincidental or not but the seller doesn;t use paypal much and would be unlikely to have the funds in his account to remove and would therefore possibly have cost paypal money at first if they had found in his favour.

    I didn't realise just how useless paypal were until this year. I've used them for about 2 years without any problems while buying and selling stuff on ebay but recently lost over £200 basically because the sellers (both 200+ positive ones) did a runner with my money and didn't deliver. I called paypal after a week on each occasion to advise no goods had arrived. Each time they said I must allow 14 days. So I waited in each case until the 15th day. Called up and they said no problem we'll reclaim your money from the seller. But oh no the seller's had cleared their attached bank accounts so I just got a message back from paypal saying they couldn't get the money back for me until such time as the seller used the attached bank account again! What a daft set of rules as those people that run off with your money aren't likely to suddenly fund that account again. I had an arguement with paypal about there safeguard they push but threy said only if money there to take! :mad:

    These replies are all very well, but none of them are relevant, I asked a question as to what I can do to get my money back.

    I did email them about this and have received this morning a statement saying that the case is still closed as PayPal do not cover items not received through eBay.

    I made no mention of eBay in my claim, it wasn't an eBay transaction, are their staff really that stupid or do they just not care?

    That's the point - they know it wasn't an ebay transaction, therefore you're (according to them) not covered.

    Your only hope is that you funded the paypal payment with your credit card. If you did, you can go to your credit card company for help getting the money back.

    Unfortunately I paid senditquick.com using their pay with PayPal option from the funds that I had in my account, looks like I will taking this to small claims court then.

    Perhaps I should have quoted what PayPal said, as the way I have stated it is misleading.

    'Your case ID PP-XXX-XXX-766 has been closed as we only cover non eBay
    > items for non receipt. Thus, your not as described case is not covered.
    > under our Buyer Protection Policy.'


    Paypal have shot themselves in the foot as what they get from me in fees each month is far greater than the loss I have incurred due to the damage and late delivery, I can at least take the satisfaction that I will not be offering it as a payment option on eBay anymore.

    Good for you, John...but I wonder whether that'll affect your ebay sales? I only ever look for items I can pay through Paypal for.

    I think what that quote from paypal means is they'd have covered you if the item had not arrived... but not if it arrived not-as-described (ie broken)

    Really, it should be senditquick sorting this out, which is probably why paypal have washed their hands of it.

    So essentially PayPal has created a situation where any courier who accepts payment for delivery through PayPal has a licence to rip off its customers, they can take the higher fee for next day delivery but are under no obligation to deliver that service as long as it gets to the customer eventually.

    I thought that PayPal would automatically have found in my favour since SenditQuick hasn't responded to emails sent through PayPal, it isn't as if PayPal are actually going to be out of pocket refunding me the money, it would have been taken out of Senditquick.com's account.

    Well let that be a lesson to us all, don't use PayPal to pay for courier services.

    I think we need to re reread the OP here. John-T has his table, it has been delivered, but is looking for compensation for damage. This is a tricky area and whilst I appreciate many people don't like paypal I would be interested in what other payment methods they would suggest we use that will compensate for damage automatically?

    To answer the specific question raised by the OP, I would think your only recourse is the small claims court, claiming for damaged item etc would fall naturally in their remit. Also talk to Citziens advice, did anyone formally sign for delivery, was it delivered unpacked and was it signed for wrapped and damage unseen? Was mention made on delivery slip that item was not inspected?

    Once you have collated all your information a claim can be raise through the courts service online, I' sorry I can't advise how to do that but others have mentioned doing it and i'm sure they can advise further.
