Problem with other parties insurers not repairing all of the damage

Hi all. I would like some advise if possible. I had my car hit when I was driving along a road, the wheel arch trim needed replaced which they have done, scrapes which they have done, mud flap replaced which they have done but there is 2 small dents in the impact area were I was hit. I picked my car up from the repairers which the other parties insurance sorted for me to find that the 2 dents have not been fixed. after 2 weeks of phone calls an engineer of the insurance has informed the repair garage that he does not beleive the dents were off the impact
I know my car and I know that the 2 dents were not there prior to the crash, the repair garage in a sort of a way practically acused me of adding the dents onto the damage as he said people do it and in his 28 years of being a body repair garage he said they were not off the impact and was car door damage I told him that the dents are 4 foot high on a panel resessed back 3 inches back from the wheel arch and there is no way a car door could have done them as the door is not high enough and the door would hit my wheel arch as it sticks out past the body. I don't know what to do! I have no solicitor involved at present bit think I might have one involved as they are not going to repair it. Any advise on this

  • Hi Maximus.....as i told you when you first had your accident , i think you should get a solicitor involved.

    Look at the hassle you have suffered owing to this accident already !

    Its not worth the hassle. The accident is clearly not your fault so you wont have to pay a penny to get legal representation , that will all be paid by the third party so you have nothing to loose by instructing a solicitor.

    Seriously , pass the matter on and avoid the stress.

    Or ask the insurer to send out an independent assessor to look at the vehicle and see if the damage is consistent with what has happened? If he rules in your favour brilliant they will repair it... if not and he says it isn't related sadly your stuck! At least then you know :) It's no more or less than a solicitor will do to resolve this.
