    Why are YOU doing all this - it's your husband that should be contacting them. It could be why you are getting nowhere.

    Was the letter dated March 2010 and thus issued late or was it lost in the post?

    I think you must have mis read me. When i recieved the letter i got in touch with the company and asked what the package was to be told we were to late and to check the date of the letter.
    The letter was dated March 2009 and we recieved it march 2010. Th e company said that the manager responsible had retired and it must have fell down the back of his drawer and then when a new manager started he must have found it and posted it to us and thats why it was a year too late

    If a company don't send a letter for a year, then your husband needs the union to fight his corner and get the same deal or better....

    You should not be doing all the communication with the company.

    Hi I am doing all this because not only is my husband suffering from diabetes but is also suffering from severe mental illness, he can,t cope with every day life let alone something like this. Originally the union were meant to be helping but we haven,t had much help at all.

    I fully agree that we should not be doing all the communication with the company but if the union guy (whom we have found out since that he is leaving the company in the new year but he has not informed us ) doesnt give a toss who do we turn to.?

    I suspect what the OP means is that they were offering voluntary redundancy with pension payable for those over 50. That possibility ended in March 2010 when the age for receiving a pension rose to 55 instead of 50. The package had to have been in place by 31 March 2010 or not at all - I applied for the same thing with my job but was unsuccessful so would also have had to wait until I was 55. The company cannot do anything about that, although presumably they could still offer redundancy.

    OP, hope something gets sorted - do try and enjoy a good Christmas if you can

    Yes thats right but they sent out this offer to all the workforce in 2009 but we didn,t recieve ours until 2010, so we were advised to go for ill health retirement and we got everyones support and the works doctor support with all the letters off the medical people involved. The union guy checked every thing over and assured us we would get this. So you can imagine our shock when we recieved a letter refusing to give my husband ihr. The company just put in the letter that he didn,t come under the rules and the decision was final. So now we have missed out on both early realease and ill health retirement and to top it all the company are no longer going to pay him his sick pay. Lovely christmas present from a caring company.

    A caring company that has had no work from someone for over a year......did they pay contractual sick pay or SSP?

    If it is the former then they are a caring company but you cannot expect them to carry on paying someone for no work.

    Circumstances do not look great and you need to be complaining about the lack of action from the union to the Union superiors.

    On the other note he will have been accruing holiday pay throughout his sickness so you could look at getting this paid to you to help short term maybe?

    Firstly get back onto the union and complain at them for their useless rep!

  • Your husband may be entitled to DLA? If he qualifies, you may qualify for careers allownace. Visit the Citizen Advice Bureau for a Benefits Check.

    You need to take legal advice. Do you have contents insurance? If so, contact them asap to check whether you have legal expense cover. If you do, your legal fess should be covered. If not, try to get hold of a "no win, no fee" solicitor. Contact the law society for this or visit the local citizen advice bureau for a list of local solicitors.
