They can close the account if they wish.
Family members are normally presumed to have access to all card details because they have plenty of opportunity to look at the card and get them. But not the PIN.
It appears that there may be a misunderstanding about whether the PIN was disclosed rather than just the details that a family member or random shop assistant has access to. This might be because they presumed that the order was done in the pizza shop rather than online, so are presuming that the pin was required.
She might try clarifying that this was an online purchase, not an in-store one, and that the PIN has not been disclosed.
Her current card will already have been cancelled so she won't be able to use that card. She should have no trouble withdrawing cash from her account, there will be some process for identifying her even without a card if she withdraws money over the counter.
Case 91/4 dispute over unauthorised withdrawals from current account from the Financial Services Ombudsman may be of interest to illustrate the building society's concern and what the Ombudsman thinks is normal: "We said that – in normal circumstances – Mr M could not be considered ‘grossly negligent’ for having kept his card in his wallet, rather than under lock and key, in his own home. And it was quite likely that any close family member would have had plenty of opportunity to observe him using his PIN. So again – in normal circumstances – he could not be considered ‘grossly negligent’ for not having prevented this."0 -
So basically the story that the BS has problems with is that the delivery name was that of the son, while the card details was the account owners one. I would think this happens on every other internet purchase when ordering to the OHs working place.
The only thing I think can go wrong if the pizza guys entered the card usage as "card present". I've heard some shops are only allowed to charge this way, or pretend to do this because it's cheaper for them. I would check the receipt if it shows card present/signature. If this is the case, the BS could get suspicious who actually used the card - but if it was a card present transaction, how would they know the names/addresses?
But I would think the best result is a compensation from a BS that I no longer would wish (nor had a reason) to go to...Enjoy the silence...0
