also why is the stam duty included in the mortgage offer? as this is paid seperatly by ourselves?
It's not - but the developer paying it for you is reducing the amount you are paying for the house. No different to them giving you a brown envelope stuffed with £50 notes on completion if you don't tell your mortgage provider.
You are commiting fraud by falsely representing how much you are paying for the house. In the boom, mortgage company's turned a blind eye to these things - today it's completely different.0 -
It looks like one of a few things to me-
1. You've underestimated quite how much buying a house costs and need some 'extras' to make the deal work. In which case, talk to the builder, they may help.
not that at all, i would just rarther NOT pay the stamp duty as i now believe is possible!! also the deal was agreed, now the builder is discussing the house furniture price, so is this illegal or fraud??0 -

It's all legal as long as it is disclosed to the mortgage lender and they may have to change the offer. You can't have a completely seperate transaction for contents, stamp duty etc. it's all linked to the purchase price. Before any contracts are signed you need to determine who is paying what, which contents, fixtures & fittings are included etc. as this forms part of that contract.0 -

No, it's not illegal or fraud, you just have to tell the mortgage lender.
If that's the way you want to do business, then fine, but I would be bloody embarrassed to do that.
Also, again, it was foolish not to negotiate the furniture price as part of the total deal, you are in a very poor negotiating position, as they know you're going to buy the house whatever; or they keep your reservation fee.0
