Council tax benefit affected by student partner

I'm having a benefits nightmare (yes, that old chestnut!:o ) and I was wondering if anyone else has had the same problem and how they dealt with it?
I'm on Incapacity and my boyfriend recently moved in. Being good honest citizens, we obviously informed the right people, expecting that it wouldn't make that much difference as he's a student and therefore exempt form CT. Not so, apparently! While he IS exempt, his student loan counts as part of my income and therefore they now want an extra £350 from me (which I don't have)!! My council tax benefir has gone from £46ish a month to just £6.

How can they do this - either he's exempt or not? - and what can I do about it?

    Council Tax Benefit and Council Tax are two different things when it comes to the calculations.

    For Council Tax Benefit they will count his income, but for council tax we would not exempt him (exemption only applies to a complete household of students), we would instead disregard him from the calculations, which means that you would get a 25% single persons discount.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
