Refund of Air Passenger Duty and TFC's

I'm taking Opodo to court because they have refused to refund Air Passenger Duty (APD) and other taxes, fees & charges (TFC) when I asked to cancel a non-refundable, non-changable ticket.

My argument is that ADP and TFC's are refundable because they are NOT part of the base fare for carriage. Also, as these are collected on behalf of HMRC and other 3rd parties, they are not Opodo's to keep.

If you have had a similar experience or would like to help me present this case please post here.

You've got no chance of a refund of anything apart from APD. Although airlines are obliged to refund APD they can levy an administration charge. This is often set at a level higher than the APD hence no refund.

I have to agree based on numerous previous posts. I suspect by setting the admin charge at or above APD they avoid having a department to deal with refunding it.

  • I agree which is why I've gone the Court action route, if they levy an admin charge I seek to have it ruled as contempt of court (that's of course if I win...)
  • I got a refund via Expedia last year with no admin. charge and no problem.

Are you sure that you understand what you are doing? Contempt of court is not relevant to your claim.
    Gone ... or have I?

I suggest you read the T&C of the Opodo website first as well before "taking them to court".
  • I got a refund of taxes earlier this year from Opodo - they charged an admin fee but we still got about £150 back for the taxes.
(it was also a non-refundable, non-changeable pair of tickets). - to be honest, i didn't really begrudge them and was happy to get anything back as I knew it wasn't refundable and it was our own situation that led to the cancellation so I just saw the refund as a bit of a bonus on a holiday we'd already written off...
