Sellers/vendors can't get a mortgage...again!

We had an offer accepted on our first home in September. It was sold with no forward chain (sellers moving into rented and wanted a quick sale). To ensure the house was taken off the Market the estate agents told us that we must instruct a solicitor. Within a couple of weeks we had a mortage offer, valuation and the solicitors had done most of their bit.

The first indications of a problem were when we discovered the sellers had not instructed their solicitors. In the meantime we were still being told by the estate agents that the exchange and completion would definately be before Christmas. Weeks have followed full of stalling including an incident when we were told Mrs was going into hospital.
We have now found out that the sellers want to buy a house (rather than rent) but are having problems getting a mortgage because they have CCJs!!!

Yesterday I discovered they have done this before, the exact same scenario, they left the buyers out of pocket knowing full well they wouldn't be able to get a mortgage!

We have spent over £1000 and 4months on this house and are so upset. I really can't believe sellers can do this repeatedly. What's to stop them doing this again and again? Can I take them to court for the costs, or damages?

  • Also wondered if we had any recourse as it was mandated that we instruct our solicitors to ensure the house was taken off the Market (evidently the same was not mandated for the vendors)?
  • You have no recourse if contracts havent been excnahged yet.

  • Not a lot you can do, apart from have a complete hissy fit at both the vendors, for directly wasting your time, and the EA for failing to vet their vendor properly.

    Until exchange of contracts there is nothing preventing either party from pulling out. It sometimes works to your advantage, sometimes not.

    Name and shame on a decent website that will make it appear at the top of google would be an idea..? Just for your own amusement, not because it will change anything...
