Penalty charge for leaving B. Gas

Hi,
I was on a yearly fixed tariff for gas with British Gas for year 2010. A letter was sent out saying I would be moved to Fixed Tariff 2011 and I would not need to do anything. As far as I can recall the letter did not mention penalty charges if I wanted to move at a later date which I am now intending
My question is can B. Gas charge £70 if I did not actually sign up to the new yearly deal? Is my doing nothing at the time sufficient proof in the eye's of the law that I was consenting to the renewal. I pay by direct debit by the way and I guess the new tariff has started so I'm not sure if that is further evidence of consent to stay with B.Gas for a further year

I think they are dodgy ground legally rolling over a residential contract to one with a cancellation fee however I am not a lawyer. I'd say if you complain vigorously they'll probably waive it as a goodwill gesture rather than have it go to the Ombudsmen (and potentially get hammered).Mixed Martial Arts is the greatest sport known to mankind and anyone who says it is 'a bar room brawl' has never trained in it and has no idea what they are talking about.0
