Dodgy Digibox

Hi
I got a digibox for chrimbo from my mum (a ~£30 one from Tesco) but now it's started going dodgy....

One of the scart sockets on the back doesn't work, so I can't have my TV, digibox and dvd hooked up, and occasionally (ever increasing frequency) it freezes, stops working, turns off etc.

I'm going to take it back to tesco... I still have the original box, and it has the tesco tape strapped across it (the tape they use so they know you've already paid for the electronic items) so there's no doubt where I bought it from, but before I take it back, I want to know my rights....

IMHO, an electrical item (like this) should be in decent working condition for at least 12 months. I'm within my own limit of 12 months, but would like to be armed with my MSE facts and figures when I take it back. Can they legally refuse and exchange??

cheers

Ambla

(ps- I'm after an exchange, not money back or credit note or anything..... they still sell the item, but in different packaging now.....)

  • If your product is faulty within 12 months you can take it back, you are within your rights to do so.

You have the manufactures warranty which gives you 1 year of cover and you also have the revised sales of goods act that gives you the right to "a reasonable life span" for the item (reasonable being defined by what it is - a bar of gold bullion should last longer than a bic biro for example)

The main problem that people have is proving how long they have owned the item. If you have the receipt this should all be plain sailing as both pieces of law will cover you (though it is up to the store how they deal with it in terms of replacement, repair, refund etc - given its value though it obviously wont be a repair job in this case). If you dont have the receipt you are much more relying on their goodwill unless you have some other form of evidence to prove when you bought it
