This isn't true. Jim, you should seriously consider what you're posting before you post it. If you aren't sure - keep schtum.
It certainly happened to me - I was alone, the other (lone) driver somehow miraculousy produced a witness who said I'd hit them. I told my insurer the truth. In the paperwork I did see it kept mentioning that the other car was hit from behind like that was the end of the matter - and effectively it was, I got the blame and the fault.
The law might say one thing but in practice its something else. Thats why I wondered what I could have done differently. As it was, my insurer just paid out because I had front of car damage and the other party had rear of car damage and a liar witness who wasn't even there.
But you're right, I ought to think out my wording a bit better in future since It was more a generalisation rather than intending to be a definitive statement of law or practice - You need a witness, or a police report or something to convince them otherwise.0
