  • I think you're going to just get over this one.

    When I bought my house in 2009 I bought a shoddy place that had a boiler and gas central heating installed donkeys ago. Knowing that it'd take 6 months to save for a new boiler I made sure part of my buying process was to pay for an surveyor to check on my behalf the working status of the boiler and central heating, as well as all the usual stuff you should get checked out.

    If the items then did not work then similar to the Smith Vs Bush case in 1989, I would have a case. This is because both parties have different bargaining power (me: none, expert: lots), as well as safeguarding being available to the expert (i.e insurance). If I had used a mate to check it out, or relied on the owners advice, I would not have a case as we both have the same level of bargaining power, and similar financial resources.

    I think the technical term for your situation is SOL... Sorry...

    we have been in our house since aug and the boiler looks like it came with the house when it was built 12 years ago..we are getting a new one for 2k next tuesday..just like if i bought a car and it broke down after a few months i would think tough luck m8.
    life is too short to worry....move on as a just one of those things..

    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.
  • There is no mistake. paperwork was requested and it was not supplied. The OP decided to go ahead and purchase regardless. Now there's a fault and the boiler needs to be replaced. That's hard luck but nobody's fault but the purchaser's.

    KrisMiranda: I can only assume that you either haven't read the whole thread or that you cannot understand it and therefore your contributions are useless. Perhaps you could post on a thread where you have some understanding of the subject at hand. If there is one

    And this is the key thing people seem to forget. Once a buyer is made aware of something the onus is then on them to satisfy themsleves all is OK, in this instance sight of a service record.

    If for example the xyz was faulty/did not work and when asked the vender said as much it falls on the buyer to make further checks, even if the seller knows exactly wahts wrong and what the cost may be it's up to the buyer to find out.
