leak damage from upstairs, who covers the cost?

a tenant in the upstairs property went out and left thair water on (they deny that they did, saying that there was a plumbing leak ) and have since moved out.

Our insurance ar covering the majority of the cost , but for a few bits they are not. my question is really is the landlord accountable for the damage or the tenant?

  • Talk to the landlord: it's up to them to either pay you out of their own pocket, claim on their insurance or seek redress from their ex-tenant

    i have done. he is passing the buck onto the tenent who has disappeared...
  • If the landlord's name is on the property deeds, it is his responsibility.

    There are a couple of things you can do:
    - get a plumber out to confirm it is not a leak from your property (will probably cost for a call-out) or take pictures of the leak.
    - contact the Environmental Health section of your local council. Explain to them the situation, and give them the address and details of the landlord and the property where the leak is. They will contact the landlord and force them to fix them problem.
    It comes with the territory and it is their responsibility.
