Auto Credit Finance PPI claim

Hi there,
I have had a claim against auto credit finance for a missold PPI. Followed the MSE and forum trial and error rule book. I managed to get a decision in my favor via the FOS. They said they couldn't do anything as the company was bust. I took the loan out in 2006 for car.
They referred me to the FSCS who then posted me to Delioitte.
My case has been with Deliotte for past 6 months. Every time I call they say they are gathering information from Auto credit finance. In my written complaint about me being missold the director stated that he was going to play hard ball. I am thinking it will take years before deliotte get a response to the information they are so called gathering
.
How long should this take? Also what happens if the company just won't provide the information Deliotte are chasing, are they legal timelines in place to ensure they give up the infomation?
The FSCS are no help and they just pass the buck back to Deliotte. Has anyone got as fustrated as me with this, please share.

Hi there
You will be fine, and it may take some time, but its only the FSCS are able to deal with this now.
One of mine for example that was dealt with by the FSCS taken about 15 months in total, that was because even though the business i complained of were registered with the FSCS, I had to wait before the business were declared in default.
Are the business already in default do you know?
If not you should not be waiting far too long now, but do keep in regular touch for updates from Deloittes and the FSCS.
There is a thread I started some time ago of companies in default and being dealt with by the FSCS, maybe this would help, good luck and please keep us posted.;)

I do recall you helping me before. Thanks once again. That was back at the FOS stage. I just had a thought about suing the company thanks all as I don't want them to get away. They basically tucked everyone up with PPI like others out there.
Will have to just keep the FSCS and Deliotte on there toes. It must be attracting some interest now. Do you know the rate of insurance FSCS pay out, so I can do a rough estimate? The harder one works the luckier one gets!0 -

Take a look here. Good luck with this and keep us posted.0 -

You cant sue a company that doesnt exist. Plus, the onus on you in the courts is greater than that which the FOS work to. Indeed, there are now court cases going through where lenders are winning whereas had that person used the FOS, the would probably have won.
The FSCS can take years.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. They are not financial advice and you should not treat them as such. If you feel an area discussed may be relevant to you, then please seek advice from an Independent Financial Adviser local to you.0 -
Thanks for the information. I just wish the whole financial system was clearer, with less onus on the individual when something goes wrong instead of slow to act regulation and lenders who turn a blind eye to complaints for a fast buck. I will keep fighting and post any news. The harder one works the luckier one gets!0

A few months again I was moaning to you all about the lengths of ppi reclaims via Deloitte, however today to my surprise a Fscs cheque came for over 600 :j:money:
It only took 4 years since my claim the actual repayment was 400 then the rest was interest which was surprising!
To all those currently at war with a company via Fscs and Deloitte just keep at it and get up Deloitte's back side call them once a week get the name and email address of your claim handler. At which point I used outlook to send automate emails once a week to my handler and after a month of no replies I then cranked in to five emails a day.
It must have been annoying for them. I think I have earned the money now. I will never do ppi again now get credit that I can not afford to pay off reasonably quickly.
At last this thread has come to an end.The harder one works the luckier one gets!0 -
