JSA sanction and CWP help please

Hello. I have recived a jsa sanction, for 8 weeks
me my partner have baby 5 months old
joint claim jsa
we are eledgeable for cold weather payments because of child under 5yrs, we got one last week, and when everyone else in my area got one this week, i didnt. Does jsa sanction stop cold weather payments?
the jsa think that me and my family can live off 140/fortnight and run a house, CWP was a lifeline for us, and i hope my payments just late. Ive appealed the sanction and being awarded hardship payments at 40% reduction of JSA,
Im so stressed and upset, and worried, this is not a good time to worry aBout keeping my family warm, surely at the risk of our child getting seriusly ill they cannot sanction us AND take away cold weather payments? my gas bill remains half payed sinse the start of this trouble and is now 4 weeks overdue, how are we to cook? keep warm.

maybe the sanction is just the new goverments way of saving money. OVer the winter period i'll be squableing to keep warm and well, whist the goverment dont pay us as much money and they take cwp from us, thats alot of saving for the goverment.. And dont get me wrong, i do apply for lots of jobs, i mean this in all seriusness. i am really worried, but at the same time i suppose the goverment doesnt have to support me and my family, i hate feeling like im taking from the public purse, and i understoof benifits was for when there was no money coming in
when i was working i had cable internet and contract phone, both are contract nearly finished soon and i would hate to ruin furthermore my credit rateing as i trry really hard to pay them.. canceling now would make no sense but i cannot afford them if we have to use the money for food and gas and elec

Because the people in jsa said i didnt apply for a job. i genuinely lost the sheet of paper i was given and when i signed on next, i told her this. i have alot on my mind and genuinely i didnt know i had to apply for every single job i was printed out i was just told 3 things a week and that perticular fortnight i did loads of things!, which i wrote down, i generally look for/ apply for quite a few jobs a week. however i agree i deserver to be sanctioned if im not theres no initiative for me to look for a job and feed my family. however my main concern, is the health of my family. even if i cancel the none necetitis i.e my contracts that only saves me 40 pounds a month. im not going to be able to make ends meet. the only real solution is for me to get a job which i would happily do but for some its not that easy.
my main concern is does the sanction and claiming hardship stop Cold weather payments? we get it for a good reason and thats to keep our child warm, because we have a sanction they totally dis-reguard the fact we have a child to keep healthy?0 -
Sanctions do not affect entitlement, I *think* CWP are based on entitlement, so you should be okay. I'm no expert though.
I can help with the sanction, you just need to make some sense.0 -
i do not have a better way to explain it. i lost the sheet of paper, as explained above and i did not apply for job in question. i hope your right that it does not affect entitlement, but an extra 25 pounds will be really usefull right now. im just so upset about the whole thing. i just cant possibly get out of the downwards spiral that my life is heading into right now.

Since when are CWPs a necessity? They are a generous bonus. You have more than adequate income to live on porridge and heat one room for a few weeks. Not much point imposing a sanction if it does not cause 'hardship' (or inconvenience, more realistically.)
You are being sanctioned and you can not live on £70 per week? Your sums do not add up. £300 per month must be more than enough for necessities. Cable internet and contract phone - can't be more than £60. £100 for fuel. £20 per week for food.
If you can't live on that then an extra £25 is not going to make a blind bit of difference. That is even if there are any qualifying periods - have there, recently?0 -
Your right. in theory, what you are saying, is very correct. however £25 to help with heating will help us greatly, you dont know my ciscumstances though? do you. i dont wish to go into that though, not here. However the question is does a sanction affect any cwp's that are due. i suppose tomorow i can call the jobcenter who will tell me who to call to find out if its affected, but i guess i wanted to go to sleep tonight not having to worry about how me and my family are going to get by the next few months. but dont worry, consider this thread closed. i wanted peace of mind tonight so i could end this nightmare and not have to worry. We all get by dont we? so i suppose thats what i shall do. thanks for your time and replies.0

You should qualify as Hardship Payments (which is what I assume you are getting) are classed as payments of Income Based JSA and can qualify the person for other help normally available from the Social Fund - which is where a CWP is made from - such as Budgeting Loans, Community Care Grants, Sure Start Maternity Grants etc.0

On the day the CWP was triggered were you actually in receipt of JSA (whether normal JSA or Hardship Payment)? If the day of the trigger fell in between the former stopping and the latter starting then you may have missed the "computer run" the DWP do in order to get the payment into the bank for a certain date. This is because if you are sanctioned you are not classed as being in receipt of JSA IB until the Hardship Payment actually starts. As long as you received JSA (IB) in one form or another for at least one of the days that falls under the period of cold weather that the missed payment is for then you will receive the CWP but it's possible that you may have to wait a little bit longer to get the payment.0

well. That seems a little more... easier to digest. And i belive it might have just fallen inbetween.
Generaly the rules state, unless under cirtain circum stances hardship is not spaid for first 2 weeks of a claim, unless under cirtain circumstances, one of those incuding a chld under 5. I claim the exact day i found out about the sanction, so there should be no gap. so im hopeing the extra help (cwp) is on the way. Gives me peice of mind really. i'll track it all down tomorow to find out if im due the cwp. i'll update later. i'm feedin baby right now and then im going to bed.. night and thanks for your replies0 -
Slightly OT but pertinent nonetheless, have you considered a short course in improving your English? Your spelling and grammar are atrocious and you are really going to struggle to find a job writing the way you do. You are unemployed and claiming benefits so I am sure your benefits advisor could point you in the right direction.
Incidentally, I wouldn't fret too much about your child's health in this weather. I, and so many the same age as me, grew up in a mostly unheated house. The only heating we had was in the living room - and that was only put on in the evening. The rest of the house, including the bedrooms, were completely unheated. We all survived, indeed thrived. Wrap the child up in lots of light layers.0
