    Firstly I nor my ex partner have never dealt with the csa, what I pay towards is an amicable agreement. Secondly my children are in full time higher education so do have nat ins numbers which is why I have to send them. Been in touch with tax credits AGAIN!!!! explaining that I have had conflicting views on whether I am allowed to make the claim.

    Insisted I spoke to a manager which I did........eventually!!! Explained everything as I have previously posted here. There answer was, I can make the claim because my ex partner doesn't claim anything, as I have already mentioned. I told them what I provided financially, and that they stay weekends, holidays etc. So therefore the child tax credits are for the children whilst in my care.

    I was also informed that if my ex wife did ever make a legitimate claim for tax credits and child tax credits she would get them both as she IS, I and the tax credits manager agreed, the main carer. I do take on board, and appretiate everyones advice and feedback, must admit tho, not really sure what to do for the best!!!! dont want to risk going down the road of making a false claim. where to next???????????? thanks again everyone.

    Do not claim child tax credits or working tax credits as you are not the main carer for the children it really is that simple. If you choose to ignore all the posts here and on CAG that is your choice, but I can state without a doubt you are not eligible to claim them.

    Although why I am continuing to post on this thread really is beyond me because you really aren't taking a on board what has been said to you.

    You will get an overpayment as you would be fraudlently claiming these benefits.

    but couldn't the rule on the main residence be different when one parent doesn't claim? It does sound like playing the system, but why not. The only thing I would say though is that since your ex partner IS the main provider (as yourself agree), surely the extra money should go towards your children not just for when they are for you...ie, not to increase your income and that of your new family, but your children from your first relationship. After all, £20 a week for two children can be much a contribution from what they actually cost.

    No - why would it be? The money is there to keep children out of poverty and ensure they have the essentials. So if he PWC has more than enough income in their household NOT to qualify for this payment, why would it go to the NRP? Because (I know its not the case here) but the NRP may never see those children, and yet claim for them.

    Sorry OP, but I have checked the act and I really dont think you are eligible to claim. I am assuming that the people you spoke to are telling you you can claim for the time that you have the children with you, but as I have said tax credits are paid to the main carer, so unless you have them for 4 nights a week, you are leaving yourself open to a massive overpayment and potential fraud charges.
