Hi,
In the process of selling house as we have decided to part ways. We have accepted an offer to sell but my partner is now saying does not want to move out until they have bought another property and will not rent which is clearly the sensible thing to do.
Can I force the sale through as worried will lose the purcahser, and which is not ideal in this market to say the least

The only way to get someone to move out is by a court order which would mean involving a judge and this is probably not practical could you not financially incentivise them to go by offering a rent sweetener?0

This has crossed my mind to pay for say 3-6 months rent. That said the threat of a court order may also work, but why do you think its impractical ?

Tell them to grow up and get out would be my advise, if probably considered a little harsh.
Tell them that if they lose this sale and that if in the future the price drops you expect them to fund the difference.
IE: house selling for £200k - mortgage 100k so both due £50k for sale.
future sale is £180k - 100k = £80k left so £50k to you and £30k to them.
That should be a fair incentive to get them off their backside and find somewhere else to live.0 -

Are you currently paying towards this joint mortgage? In other words, can you get any leverage by refusing to pay towards it if they don't cooperate with the sale? Not that this kind of action will necessarily be the right incentive for them anyway.
Did you take legal advice about staying in the property with your kids and your partner moving out? Are you happy for the property to be sold? Are you currently living in the same property together?
If the abuse re-occurs, look at the Womens Aid or Shelter site (relationship breakdown section) for advice.0 -
I'm sorry but why should a legal occupier of their own house have to leave? Why should a mortgage paying home owner have to sell their house because partner has decided to move on and they want the cash? It would take some time and cost before a judge can force a sale. There are plenty of threads on here where partners take ages to force a sale and that is after the divorce and financial seperation. To be realistic I think your partner will sell when they are ready to leave.0
