Where do I stand with this?

Hi there,
A friend and I were looking to move in the new year. We found a place at the end of November we liked, but said we couldn't move until 2nd January. So the estate agent said for us to give him the first months rent (paid end of Nov) to stop others viewing the property and to pay the security deposit/bond on the day we moved.
Since then, my mums other house has come up for rent, considerably cheaper and considerably bigger, and we have decided to move there instead. Where do we stand claiming back any money from the estate agents? I don't think we stand much chance lol, but it would be nice if we could get it back! We also paid for references but I know we won't get that back lol!

Not signing anything cuts both ways. You have no proof of the terms for deposit-holding, that might have held a get-out clause. Nor are they able to impose further charges on you - at least you didn't pay a bond, too.

Yup pretty much what we thought! Gonna ask anyway but if they say no it don't matter, we'll have that money back pretty quick from savings on lower rent anyway lol0

I think that not only are you are unlikely to get the money back but that you have created a contract to rent the property and the LL could potentially sue you for further rent.
That said you can ask the question and the LL might be nice and give you some back.0 -
Agent stopped other viewers so has lost potential REAL tenants (as opposed to someone pretending to be a prospective tenant). The landlord is out of pocket. I certainly wouldn't return the deposit.
As said above, you may also be liable for future rent.0 -

Just spoke to letting agents. They were very nice about it, and understood the change of circumstances. So looks like I'm moving somewhere better and cheap in the new year0
