    Hello , i am having the same problem with this company they contacted me after finding one of leaflets they asked if i was intertested in advertising on there planner i also asked them to send me some more info about the company and what i would be purchasing out before i made a decision , today i recieve a invoice for 145 pounds when i have not told them to go ahead with the add , i emailed them asking why i have been sent this invoice and i would not be paying it , the reply i got was i will apply to the court this week for a warrant so goods can be removed from your address for the amount plus 500 on top of this for costs plus the court costs incured . I ahve search and found this company is on tapa web site as being monitored . I have just opened my business but this has really scared me after they have threatened court prooceddings unless i pay them , any ideas / advice would be great full please !

    I assume that you did NOT agree to take an advert with them?

    Then I would tell them to get stuffed ..... they have no proof & are trying to scare you .... write back to them & state that you will not be paying them anything ....

    You need to be much firmer than asking 'why are you sending me this invoice?'. You need to say 'I never ordered anything from you, I asked for further information to assist me in making a decision. Your invoice is rejected and there is now no way I will do business with you'. You need avoid appearing the least bit weak - and if they take it to court, the earlier you can show you have disputed, the better.

    You may well receive court papers, but you should resist. They are unlikely to let it go to a hearing and risk losing - you will see that they have bullied this site into removing their details - but if they lose in court, they will have no basis to insist on removing a post naming them and stating that they lost in court, as this si a matter of public record.

    As for losing in court yourself, don't be afraid of this. It is unlikely, but if you pay up within 28 or 30 days, there is zero prospect of bailiffs and it will not go on your credit record. You are allowed to have an honest dispute, let the courts settle it and expect that your credit rating will remain intact.

    Having said all this, their evidence of you having placed and order will be flimsy.

  • Thank you both for your very useful answers. It is actually for an advert in a Yearly Planner for Domestic Violence to appear in Northamptonshire. I have asked to see a copy and to know exactly what the outlets are where it will be distributed. I am waiting for an answer to this.
    I agreed on the phone apparently on 1/12 and I didn't receive any documentation relating to it until 10/12 by which time I had thought better of it.
    I have had some communication with them this afternoon which was helpful, but I am still concerned that the yearly planner might not actually exist as their website is very poor.They said I could see copies of previous issues on the site but unless I am being blind, I can't find it. I tried to include the link for you, but this site here won't allow me to do so as a new user. However if you type in h-b-w.co.uk you should find it.
    I Too have had the same problem with this company with requesting info ect.... they have then taken art work from another advert (which was my own work), they have since badgered me for payment to which i have said on neumerous occasions, i did not order this just asked for extra info... but i did place an order with then last year for a year planner for the domestic violence awarness in spen valley (west yorkshire). After counless phone calls from them demanding money & the threat of a solicitors letter (to which i am still waiting) they have taken the money from my account without my autherisation anyway...please help...the bank says i will have to wait untill 1st august before they can do anything & it will be a none fraudulent visa debit claim.....how do i get my money back??? I Personally think it should be a fraudulent claim as they have stolen my money!!!!

My advice, even if they quote "Distance Selling Regulations" is, DO NOT UNDER ANY CIRCUMSTANCES PAY THEM! And I qualify that statement by saying Do Not Pay Them Anything even if they offer you a discount. Their whole business is based on subterfuge and threat and they have no basis under English Common Law or Tort (Civil Law) to make these threats stand-up in a Court Of Law. We have referred our dispute with Heath Buchanan & Wells Ltd. To our local Trading Standards Agency and their advice is to NOT PAY THEM, as they also know of these kind of scams. You may have to "TOUGH IT OUT!" as you will receive many threats of legal action, debt collection agencies and Credit Rating damages. I can honestly say that if you stick with your principles of fair and honest trading, no Court Of Law in this Sceptred Isle will find in favour of Heath Buchanan & Wells.

  • hi all.
    i received a telephone call from these advertisers, offering a business card sized spot on the yearly domestic violence awareness planner for £145. after numerous times of saying no they finally offered me the ad for £95 inc vat, which i accepted.
    i received the proof of the advert for my approval along with an invoice which was due for payment in 2 weeks time. i wasn't happy with the proof and so changed it to a style i was happy with and emailed a copy to them requesting the change and also asking if i would receive a free copy of the planner when it was produced. after 7 days i heard nothing from them. i decided to ring them to make sure they received the new ad, but the telephone number on their headed paper was not in use. i have since sent another email asking them to contact me and after 2 days have still heard nothing, apart from a reminder invoice coming through the post.
    with both the phone being dead and their lack of contact through email and also the poorly printed headed paper and art work they sent me, i have become suspicious that i may have been scammed, and have doubts the planner will actually be produced.
    This has brought me to this forum as i decided to try and find out about them on the net and this site is the first thing that came up. i have now read their terms and conditions on their website and am left tied up in knots as it states among other jargon that the ad may not get published if their customer cancels the planner. no refund will be offered, but they will endevour to place the add in a similar publication of the same value. ( which to me reads there is no guarantee) as i was not offered a copy of the terms and conditions during the phonecall nor pointed in any direction where i could find terms and conditions is the sale classed as mis sold. also due to their lack of contact regarding my artwork, am i within my rights to cancel.
    looking forward to any advice.

  • I received a call asking me to take out an ad in a safety awareness calendar in late 2010. I was suspicious early on as they sent me text I'd written for a different advert and a photograph that was copyrighted to my husband but where they got them from we don't know. So, not great respecters of copyright. I exchanged a few emails with HBW about the ad but ultimately I cancelled it within the 7 day cooling off period and told them not to contact me again. I then heard nothing all last year.
    This morning I have received a phone call from someone - I couldn't hear very well but it seemed to relate back to this calendar. Allegedly I owe them £199 for an ad they say I asked them for (altho' I haven't heard from them since 2010). I told them I was going to put the phone down, investigate and get back to them. I found the cancellation email I'd sent but, when I tried to email, the address I had been using is no longer available and when I check my call register there's no number given for the person who called me.
    So, now I can't even ring to tell them I'll see them in court. I don't even know if it's anything to do with HBW anymore, but would be interested to know if anyone else is having similar problems and the best way to argue against people you can't contact.
