    Thanks gatita. Sorry to sound thick but why do you say make sure the assets are covered by wills in the 2 countries? They are, but how exactly does that work? If my mum gives me the house and eventually I sell it, will it still be more advantageous that waiting to inherit it. do you know?
    Pollypenny - the site is called Money Saving! My mum is not trying to avoid paying what she may have to, but if some money can be saved, then isn't that what the site is for??? In effect we are trying to avoid paying more than we need to in Spain, where my mum will not end up needing care. This is academic anyway, as she is lucky enough to have assets in UK which will be used up first for care if necessary.

    I think the point is that a UK will couldn't go to probate (or equivalent) in Spain, and vice versa. also the law in each country affects what you can do: French inheritance laws for example mean you can't leave land / property any old how. so a UK will leaving you the Spanish property might not be valid in Spain, so you need a Spanish will.

    good luck with the probate forms, which do ask about overseas assets ...
