Penalty For Driving Without Insurance

I spoke to a man yesterday who was caught driving without insurance, he had to pay a fine of £200 and his car was impounded at a charge of £150.

He paid the fine via debit card over the phone and when he went to the police station he submitted his driving licence and was given a release form for his car. However his driving licence was returned to him and it was not sent off for any endorsements to be added to it. Is it normal not to receive penalty points for this conviction or will the points be added to his licence at a later date?

It sounds like your friend was slightly lucky, it is my understanding that the licence should have been seized when he filled in the release forms, I've not heard of it being handed back before.

I have heard on occasion people avoiding penalty points, this seems to be one such example.
  • The car being impounded and the case being heard in ciurt where a minimum of 6 points will be endorsed on the driver's record, are completely separate. It is common practice for the police to seize uninsured vehicles, just to get them off the road.

The police do not seize licences!

I just spoke to to him again, the case is not going to court he was to be fined and his licence was to be seized when he brought it to the station.

If your friend opted out of appearing in court then the police should have seized his licence when he reported into the Police station, what has happened is either a police !!!!-up or your friend has been let off with the points.

    Relevance?

If he had hit a child, and the child was not at fault (and they are, more often than not), then the MIB would have compensated the child.

But he did not hit a child.

I can't comment on what he's tol,d you however, the police do NOT seize licences - they do not have the power!!!!
