Financial assessment for care home fees !!

I would just like to echo the postings of other members. How the money has been spent is of no concern to the NHS. However, if the local authority are sticking their nose in then that is a different matter. But only if it is proved there has been a deliberate deprivation of assets. It can only be deemed as deprivation if money was spent on frivilous items or given away when it was known that residential care/nursing accomodation would be required. If a person was in reasonable health when decisions were made then it is not deprivation of assets.
A person in good health could sign their house over to whoever they wished right now, but say they were to suffer a stroke which meant they needed to be placed in some form of residential care within a week of signing the property over then the local authorities would not be able to take the property into account as being theirs.
If the house is solely in the OP's names and her mother does not appear in the deeds then I do not think that the local authority can take it into account.
The law was changed in 2009 with regards to local authorities being able to chase after liable relatives for any costs they incurred in respect of an individuals care. Section 147 of the Health and Social Care Act 2008 repealed section 43 of the National Assistance Act 1948 so local authorities can not chase after relatives anymore.
