    That's deliberate deprivation of capital. They will calculate your claim as if you still had the money, for JSA purposes. If you don't qualify for Income Based benefits (and with savings of 30-40K, you don't) then you cannot qualify for SMI.

    If you want to take the risk go right on ahead. People on here aren't being nasty - they are trying to warn you. Do it your way and you could either be refused JSA(IB) and subsequently SMI for deprivation at best. At worst you could be living at Her Majestys pleasure, and I don't mean Buckingham Palace. Prison is not inevitable for all frauds but for one where it has been planned from the outset, it would be a serious possibility. Remember, they can also lok at your a long time after you have stopped claiming benefits. So, even where you appear to have got off with it, they could find out many years later down the line and prosecute then. Do you really want to have the weight of that on your shoulders just because you want the state to fund your lifestyle rather than fund it yourself? Carry on and the state will fund it, but as a prisoner and with your liberty lost.

    Given the negativity in this thread..let me put it this way..a few poeple in this country work hard and do things by the book. Most people are spoilt with benefits. Personally i have paid far more than my share of taxpaying well more than half my income at 40% for a long time and I'm still young. I will decide what I feel im entitled for, not the govt. You can disagree with that all you want.
  • That is precisely the attitude which will land you in prison. You asked questions, and you were given answers.The government decide what you are entitled to in accordance with the law. You de-fraud the system, be it on your own head. The state is there to support the needy, not the greedy. With 30-40K in savings and execting the state to pick up the tab, you fall into the latter.

    JSA doesn't take into account the level of mortgage per se only that part of the debt which qualifies as 'housing costs' under the regulations. There is a current maximum of £100'000 housing costs taken into account.

    I echo the warnings over deprivation and fraud that other posters have given.

    I feel sorry for you pathetic people with no choice other than to live in this country which is in a state of decline. All the best with your miserable lives..

    Merry Christmas... We all have choices to live elsewhere if we wish. I believe that most of us also have the right to live and work in any other european country. I would imagine you would also be in that category. But somehow you managed to get a job earning at least £60k in this country and managed to save enough and buy a house with that. I would also like to think that on that salary you would be highly qualified and could even apply for a work permit visa for any other country in the whole world...yet you stay here and ask about claiming what is in relation to that salary a meagre £605 per month in SMI.

    As I'm sure I explained to you the overpayments you have made on your mortgage do not count as long as you made them whilst you were employed. As you have cash assets over £6k then you could have the 6 months on Contributions based JSA of £65.45 per week after which you can apply for income based JSA which at that time I would assume your £14k would have dwindled down to around £6k (that's a spend rate of £300 per week. Not bad for someone being used to £60k per year) and you could claim full Income based JSA and as Income based JSA is a qualifying benefit for SMI then you would get that too.

    If you want to claim income based JSA now to get SMI then you won't get £65.45 as your assets over £6k will be taken into account. You have stated that you have £14k so you would only get £38.45 in JSA per week. There is a waiting period of 13 weeks before SMI kicks in so you will have a lower income and still have pay the mortgage. Your mortgage provider once notified of your claim for SMI will not allow you to withdraw the overpayments and you will have to spend part of the £14k anyway maintaining the balance at it's present level.

    If you try to be smart and withdraw the overpayments before the bank takes your access away then you won't get any benefits after 6 months as you will have over £16k in cash.

    How much clearer do you want this?
