Statute barred or not??? What Right's do I have???

  • yes for sure i will send anything by recorded delivery and i will make sure i have copie's of what i sent and what date i sent it. This company has totally ruined my Christmas spirit with their harrassing behaviour. The best thing about it all is that I was living in germany at the time this account was opened and they know this but still I have to fight a battle with them it's just so unfair.
  • Ahhh i see, yes that sounds about right. I mean they don't sound professional or anything on the phone it sounds like they just dragged any old bloke off the street and sat him at the desk and said answer them calls, they are just a really weird company really really odd. My father thought it was some scam at first so we checked websites and all to make sure this company is ligit that's how bad they are. Well would i be ok to leave this matter till christmas has passed then as it's all making me really miserable, I have just come out of Hospital after an operation and am suppose to rest and i have also been written off sick since June because of a stress and anxiety related illness so all this put together is a bit much to cope with as i am suppose to be resting and returning to work at the beginning of January. What do you think??

    Just my opinion, but I would get the letter sent off ASAP.

    That way you know that over xmas the company has been told formally to "bog off".

    Entirely up to you though.... If you are not feeling 100% and able to cope with this, then your call?

    Whichever you decide, don't let these morons get you down. They aren't worth it, and it's just typical debt collector tactics. Lying and being nasty with idle threats is just the most efficient way to extract money from people before they discover any better. Don't take it personally or let it worry you. Threats and lies are all they really have.

  • That's brilliant thank you so much Fermi you have been a huge help feeling much better already knowing exactly what my right's are now. I will politely tell them to "bog off" then hahahahaha the thought of that brings a smile to my face lol.

    No problem - let us all know how you get on with the letter, ignore all future calls from them, give their letters a quick glance before putting them in the shredder and have a great Christmas!

    Also, don't sign the letter - just print your name. There has been evidence from other posters that some of these companies allegedly forge signatures.
    I used to think that good grammar is important, but now I know that good wine is importanter.
  • Need more helppppppp, i got another call the other day this time they witheld their number all i got was "why have u been ignoring me"? so i told them it was seen as harrassment to keep callin me as the debt is statute barred etc., when i said that he started ranting and raving at me and called me a liar and allsorts so i put the phone down on him. He didn't call back. But only 1 day on and I have now received a Letter of "72-hour litigation notice". Is this another scare tactic of theirs or should i be taking this seriously?? I am going to see Citizens advice tomorrow but by the time i get an appointment that time scale will be long gone.
    Please help if you can, thank you ;o)

  • no haven't sent letter yet as I am at Citizens Advice tomorrow and taking all of my Paperwork with me to them so they can have a look through it all, it will get posted after I have been there. It's defo statute barred well i have never heard from these people in my life lol is ignorance the best bet?? Just so anxious that's all ;o)

    That '72 hour litigation notice' is a load of nonsense designed to panic you into contacting them to arrange payment. You need to get that letter sent off by recorded delivery if you haven't already to put the ball firmly in their court, i.e. they need to prove that the debt is a) not SB and b) yours.

    Don't be concerned by all the huffing and puffing - the only thing that makes a difference is their specific response to your letter, or court papers coming through your letterbox. Everything else is meaningless.
