I am a beneficiary under my Grandmothers Will. She died 13 years ago and other than a large collection of China worth over £30K the main asset of the estate was a loan of c£100K loaned to my Uncle. There was also 4 houses to be split between my Mother and Uncle. My mother was given the China as required by the will and the houses divided. But I haven't been paid nor have other beneficiaries. My mother and Uncle were residual beneficiaries. The loan was allegedly repaid after legal action BUT the executor won't answer questions and just says the estate is insolvent.

What action can I take? There is, I believe, case law on the amount an executor can charge as fees. What is this case?

I am aware of the Civil Procedure rule 57.13. I have sent them a letter demanding a full answer in 14 days but where do I issue the application?

    Why the 'considerable struggle' then? What did you find so difficult about posting on here?

    If you managed to reply to this thread surely it'd be equally easy to ask your question on a different board?
