AFAIK, the staff in the Northampton clearing court make the desision regarding payment, rather than any judge.

I have a loan with Tesco. All water under the bridge after 20/11 for me. A letter came last week telling me that if hadn't paid any monies by 26/10 (yesterday), that they would put me in default.
How long after default can they take me to Court?
The debt management agency I used originally said that it takes more than three weeks for them to get a CCJ going.

You dont have to go to court if you get a CCJ.
Ive been threatened by RBS,so have written to them telling them that im now on a DMP with CCCS0 -
I am on a DMP with payplan have been since Jan 06. I owe tesco finance about 23k i was paying them about £330 a month but with payplan they get about£60.
I to got a ct letter from them, payplan dealt with it Tesco went to court i didnt have to go the CCJ was issued to the same amount that i was paying.
If you aint got it you cant pay it and the court saw that, yes they issued a CCJ but my credit rating is blown anyway.0 -
They go for CCJ's to make themselves a priority creditor, I've been told to expect it from my creditors as well, who cares really, as long as they don't make me increase payments then I don't mind having a CCJ.

Having a CCJ does not make them a priority creditor if you are doing pro rata payments. They do it so that if you miss a payment they have a bigger stick to hit you with. It also leads to a charging order on your property if debts a much above 3k.
Also. My opinion is that you should always get any CCJ hearing moved to a court near you and you should go. It shows the court you care. It also stops your creditors lying about you because you can dispute anything inaccurate. If you have been harrassed on the phone you can tell the court that. You can also dispute any extra charges and interest they have applied, especially if you have been making offers and writing to them and been ignored (take all your records of this with you). You should always ask for interest to be frozen. It is usual for the court to do this, but its not 100% automatic.
Be aware that with bigger debts (5k+) you can get put on the court rate of interest of 8%.
With CCCS, etc... They just fill out the paperwork and send it off. There are instances on this board where the paperwork was lost by either the court or CCCS, so if you go yourself this can be sorted out immediately without needing another hearing later.
If you are in danger of a charging order you might consider taking the payment of the CCJ out of CCCS etc hands and paying that debt directly yourself. There was one thread where someone on here went to court and told the court CCCS were paying but the court didn't believe them and they had no CCCS records to prove otherwise. Given that possibility I'd definately want everything in my hands and not a third parties. In all fairness I will point out that one or two others on MSE over the last year have said they don't agree with me on this. They feel creditors like a third party to handle things impartially and it works better. I'm more balsy these days and I'd want to see them in court. For those of you of a nervous disposition as regards creditors you can just leave it to CCCS etc to sort out.
One final thing. You should realise CCCS etc do not fight charging orders for you, they accept them and rubber stamp the paperwork. If you want to fight a charging order you must do it yourself.
