Halifax overdraft refered to DCA

I havnt posted much on here but im in need of advice.
Im in really bad debt ( A total of nearly £14,000)
I have 2 payment plans with 2 creditors. One i pay £5 a month (hvae been doing so for about 2 years, owed them last 4 years) and the other £1 a month.

Well i now owe £1823.85 on a Halifax overdraft.
When they contacted me over it they tried to get me to pay £15 a month which i couldnt afford. I told them and they said without debt advice they couldnt accept less. I told them i was already under CAB with 2 other creditors so then they accepted £1 a month. I got a letter to confirm. Then literaly couple of weeks later i got letter demanding full payment. Then my bank account was shut down so i couldnt make payments into it. I wrote to them asking for bank details so i could pay them £1 a month but got no answer. I didnt want to ring and be pressured into paying more when i dont physcially have the money!!
Then i got letters from Albion and phone calls day and night demanding full payment. They wouldnt accept my £1. I told them i owed a creditor 10 times what i owe them and they are happy to recieve £5 so they wanted £5 which i agreed to so set up standing order. Now im getting letters from Blair, Oliver and Scott demanding full payment?????
Who the hell do i owe this money too???????
I dont know who to send my income/expenditure too??
Should i send to Halifax??

  • Hi I have been in a similar situation to you not quite as bad but still owed Halifax £1400.
    Your account with Halifax has been closed and sold to Blair, Oliver etc. You now owe them the money Halifax have washed their hands of you (sorry to be blunt however they want their money back and obviously feel that they much rather have 30p/£ or however much Blair Oliver etc have offered for the debt than your £1 a month simple economics unfortunately)
    You need to be sending all your income and expenditure to the DCA and not Halifax and recorded delivery. Best of Luck as most of these companies are real pigs I would only deal with them via letter only refuse to speak to them on the phone. Hope that helps I don’t see them accepting anything less than £75.00 p/m as this one is one of the worst in my opinon

    Presuming the bank was willing to scrap the interest, it would have taken you only 150 years to off pay that debt.
    No wonder, the bank didn't consider your payment scheme the 'deal of the century'.

    With your debts and no income, you should take serious advice about bankruptcy.
  • Blair Oliver Scott is just another internal department to HBOS. They are the last stage before they really sell the debt externally.
    They are set up to look like an external DCA to try and influence people to pay.

    I would send back you SOA to them and hopefully they should accept your plan or else it will sold to an external DCA
  • The £1 a month was a token gesture to stop the letters till im in a better position to offer more.
    I found some template letters on the Consumer Action group by googling so im sending a financial hardship letter again to see what they will do as i have NO spare income to pay them.
    I would love to go bankrupt but heck i dont have £600 otherwise i would of offered £600 to halifax to settle debt as most of it is interest over the last 12months and £155 a month in unarranged overdraft charges so £600 would be fair lol.

  • Well they have refused my token payment offer but took the money anyways! They are ringing me constantly for FULL payment so ive decided to ignore them. They can take me to court!

    I would speak to the CAB and get them to write to them, ignoring isnt the answer and will just end up more costs and ccj

    I have many an experience with Blair oliver and scott, they are bl*&dy hard work. BUT they are now playing ball on my terms now so if you need any help with them, I'm more than happy to share how I have dealt with them.

    First and foremost to get them to stop ringing you, tell them you will only correspond to them in writing and that they are in fact committing an offence under section 40 of the Administration of Justice Act by unduly harassing you after you have attempted to come to an arrangement with them.

    You say that they have cashed your token payment anyway, which to me suggests an acceptence, which you may want to point out to them. Also, you can only pay them what you can afford which they know full well, all this jumping up and down is just to make doubly sure that you haven't got a stack of spare cash under the mattress :rotfl:

    Keep writing to them and keep offering what you have always offered them and keep sending the token amount every month, that way if they ever do go the court route (EXTREMELY unlikely) you have everything possible to back you up that you have made sufficient effort to clear the debts to the best of your ability.

    Just to let you know, it's a load of absolute tosh that they can't take token or reduced payments. I paid £1 a month for 6 months and am now paying a significantly reduced monthly amount of just £6.60 so it can be done!

    Yes they have took about 3 months at £1 then i upped it to £5 and they have taken 3 months at £5 so they happily taking my money. Although im paying it to my halifax account that has the overdraft. It has been closed and interest frozen but i get a statement each month showing my payment gone in and the balance coming down.
    I am paying what i can each month and when i can sending a couple of quid extra not much else i can do!
