    they could argue it would make it worse - if you were paying enough attention to notice he was on the phone, you should've seen the big white van he's sitting in coming up your inside*

    But assuming a strict liability situation it makes no difference whether someone is on the phone or not.

    Like people have said , the insurance company and police will look at who is liable and they have decided you. They are in a buisness , unfortunatly for you the decision they made was not what you wanted to hear. If you think I was having a go then so be it , merging traffic being both a van driver, car driver , motorcucle rider is one of my pet grips. As is people who consider merging at the last minute . Yes regardless of the insurance decision you can contest it , but at the end of the day it could do more damage than good. Its amazing how many people especially when it comes to right of way etc think they are in the right . I know Ive been there on both sides . Oh its an open forum , if you dont like some replys people give , simples solution , dont post . I am now very bored of this thread as you seem to have singled me out as the one thats having a go. So yaaaaaaaaaaaaaawn. Im off to bed. Again bloody baby !

    We are accident claim company registed with ministery of justice. My advise is to you that you should not accept liability. I beleive your case can be settled on the basis of 50/50. If you want me to deal with your case on no win no fee basis ( no charges from you) basis. I am will to take your case. contact me on my number ***************.

    I'd love to see asadkhans claims management company take on a claim that is less than the policy excess so for damage of probably £300 which if it was on a 50/50 basis worth about £150 to them. He may be able to generate a day or two of expensive credit hire.

    If he had bothered reading the whole thread he would have seen the value of the claim and it's not worth it to him unless he was going to try and talk the op into claiming for an injury...

    I'm not singling you out and I'm not having a go at you. It is an open forum but it would be nice if people just answered the question I asked. I couldn't care less whether you or anybody else thinks that I'm in the right or in the wrong. None of you were there so you have no grounds to pass an opinion on that.

    Some people have taken the time to actually answer the quesrtion I asked. I'm grateful to those people. I really don't understand why the other people bother.
  • Did you give the white van driver your details or did you give the white van driver your insurance companies details?

    If the driver only has your details then they will have to contact you first. You don't have to involve your insurance company (although people say you should inform them of any accidents). You can settle the matter yourself either by paying for the damage if it's your fault or claiming against them if it's theirs or saying see you in court if there is a difference of opinion.

    However if you choose to deal with it yourself and loose I don't think you will have much luck getting money out of your insurers.

    Similarly I don't think you will have much luck instructing your insurance company to start a legal battle at their expense (because you are only liable for the excess) if they don't think they will win.

    Basically your choice is to deal with it your self and accept the consequences (good or bad) or pass the whole thing over to your insurers and accept their decisions.

    I have now received a letter from Equity in which they state that if they receive a claim from the third party they think the best course of action would be to settle it at the lowest cost.

    Am I within my rights to instruct the insurance company that they CANNOT settle any claims and that the driver of the van must pursue the claim in court?

    YOU WERE AT FAULT. You chose to keep on going. Your insurance company have made their minds up as well. Insurance companies don't decide to settle on a whim - they do everything not to - however the evidence you provided them gave them no option. If it went to court, you would not only have to pay out the repair costs but also the third parties legal fees AS YOU WOULD LOSE.

    The traffic was merging. I merged because there was a gap and a bloke in a white van, on the phone, drove into the side of me.

    I'm wasting my time here. This is only my second thread on this forum but I have already come to the conclusion that it's just not worth asking you questions.

    Picture this:

    I'm driving my 44 tonne lorry at 56MPH in L1 on the motorway. A typical car driver who expects traffic to move into L2 to let him on the motorway, pulls out from the sliproad in front of me. I ram into the side of him.

    He is at fault. No ifs, no buts, nothing. The Police, if called, would charge him with driving without due care and attention.

    He'd never get into the space between you and the car 6 inches in front of you.
