Well, him being on the phone is completely irrelevant really. You merged into the lane he was driving in, so you were at fault and your insurance company will pay out on that basis.
There must be some circumstances that are rather ambiguous as to who's at fault in an accident, in that case your insurer will investigate. But this is an easy one to prove who is at fault, and even if you did ask your insurer not to pay out, they wouldn't listen to you in an open and shut case like this one.0 -

To be fair, when the chav in the Fiesta hit me, I reported it to the Police (because he drove off) and my insurance company. A week later I got a letter from the cops saying they weren't taking any further action and a letter from Direct Line informing me they were paying out.
I was livid. It's an understandable emotion to have when something like that happens. I took every precaution to make sure the lane was clear before I moved into it, and because the chav came flying round the corner like a lunatic he couldn't stop in time. But because I was the one changing lanes, it was my fault.
I understand the OP's frustration completely. But asking the insurer not to pay out is pretty futile in this instance.0 -

Nothing to take further I guess. My fault, and he obviously had the necessary documents to allow him to drive a car on the road.

I'd hate to get stuck in the right hand lane in traffic behind some of the posters on this thread (Gene Hunt, Innactive et al) - sounds like they'd never merge in because its clearly wrong/illegal/stupid/dangerous so i'd probably be stuck there for days.......
Mind you, they are probably the same people who sit in the middle lane.....0 -
