Letting agent wnat to withold deposit

New to this but frustrated by cowboy letting agent and landlady.
Tenancy agreement was for 6 months, property was filthy when we moved in, mountains of complaints never dealt with, eventually had to get env health officer in. He issued a notice to landlady, she shodily repaired one item on the list.
Constant issue with windows, drain pipes unconnected, water running down windows, blocked toilet, damp / mould on interior wall, no smoke alarms etc etc.
tennancy now up, we moved out, agent with holding deposit.
What do we do now, the deposit is within a scheme apparently?

    Your header say 'letting agent wants to hold deposit', but your text makes no reference as to why this is. On what grounds? Was the inventory and inspection carried out in your presence? Is she alleging items missing or damaged? If you have given her notice of the faults you describe in writing, which I trust you did, then she cannot later allege that these were caused by the tenant.

    There will be an audit trail as Environmental Health were brought in and issued a notice. Therefore, the next step if the letting agents are going to withhold the deposit is to open a disagreement with this with the Tenancy Deposit scheme that they used.
  • Raise the dispute with your tenancy deposit company. They will ask both sides to submit evidence and make a decision. The cheque can take a while to come through though.
