No way! I am the last to say that council's can't get things wrong - but never this far off the mark. I am laying bets that you are on a zero hours contract - that is a contract where you are not promised any specific hours of work and you are told when and where you are working. That will be the reason why you do not receive sickpay and have no right to join the pension scheme - neither of which apply to zero hours contracts. Also, zero hours contracts are one of the exceptions in relation to rolled up holiday pay, and it can be included in your "hourly rate". Zero hours contracts are used in a number of fields - and sports coaching is one of them.

As has been suggested, I suggest that you speak to HR who will explain the terms of your employment, and if you have lost, or never received, the terms of employment they will no doubt be able to give you a copy. But I will bet that I am right about the type of employment, because council's just don't make such huge errors as failing to do any of the things that they should do as employers!

I'll bet SarEl is right as well, there's no doubt in my mind you ARE on a zero hours contract. Even the stupidest of Councils would find it difficult to be THIS stupid!

yes, but what do HR say? if they are paying you, they must have some basis on which they are doing so.

If you haven't got a contract, then what the heck are you doing going into work each day?
If you haven't got it - please don't flaunt it. TIA.

Accounting procedures in local authority payroll departments are very tight. They cannot begin to pay someone, never mind continue to pay them, without all the correct forms from someone authorised to sign them. So there is a contract somewhere. But as people have said - there seems to be a problem here in asking the right people. How do you get paid? What does it say on your payslip?
  • Hi again thanks for all the info..

I get paid by filling in a time sheet on what i have worked. and i am paid by the council.

I contacted HM and asked for a coppy of my Terms and conditions of employment and they didnt have a clue what i was talking about. i was then told that i didnt have one.

i am now going to the CAB and see if they can help.
