    The dept is in my name, we are both classed as self employed and at the moment we get Full council tax & housing benefits

    The expert on bailiffs is Herbie21. She provided this advice to a previous OP.

    You need to WRITE to Equita or better still send an e-mail to:

    You need to say something along the following lines.

    I refer to the above account in relation to unpaid council tax due to xxxx

    As you will be aware from your files this account has been assed to your bailiff Mr xxx to enforce.

    The query that I have is concerning the amount that your bailiff is now stating is due. You will be aware that your bailiff visited my premises on xxx and for this visit I am advised that Mr xxx may only charge a fee of £36.00 for "attending to levy where a levy was made".

    As a matter of urgency can you please provide a full and detailed breakdown of the charges made by your bailiff.

    If they do not levy the car and you do not let the bailiff into the property- the bailiff will send it back to Equita as un-collectable who in turn will send it back to Walsall Council.

    Council Tax Recovery will then contact you again to give you a final chance to make payment. At this point you can then provide an income an expenditure and an offer of payment and they will accept it.

    As it being collected by Equita, I am assuming it is for this years bill?

    edit - the bailiff has to have peaceful entry and can not force doors/ windows. Ensure they remain locked at all times
    I am a debt counsellor working in the voluntary sector - we don't charge our clients for the work we do!

    if they have already down a levy on the car then they can make additional charges.

    if they have already levied on the car that it very dangerous advice.

    I was under the impression they had said they would take the car, that there was no actual levy.

    But, the bit about

    is surely wrong, they can't just keep piling on the charges can they? At some point don't they send it back to the Council.

    Its a Form 7
    Notice of Seizure & inventory of Goods

    It States the cars Vehicle Reg and then details of the car. They have obviously just pulled up and taken the details of the vehicle then wrote it on this form 7 and left it on the doorstep

    Not sure if that means they have a Levy???

    it means they have a levy and can charge you £36 for the privilege of doing it (they could charge £24.50 for a visit where they failed to levy).

    Please will you click in the link that I posted earlier and check whether you can stop them levying on a car for business use against domestic CT. There are rules re works vans and business rates, so you may be lucky.

    You cannot stop them levying if you use the car to get to work but if your employment is impossible to continue without the car, you may be OK.
