Periodic Tenancy - When do I have to give notice?
Comments
-
Hi. The LA and LL are still refusing to answer me on whether the notice is accepted and/or what date I need to vacate on.
I am worried that they are trying to keep their options open on whether they want to accept the notice or not, and just let me know around the 6th.
Can they do this, and is there anything I can do about it?0 -
If you write and push the issue, you may find they say the notice was late and you have to re-submit and pay another month.
I'd advise continuing correspondance on related matters, without actually demanding a written acceptance from them. If they send a series of letters/emails explaining what repairs/cleaning you need to do before 6th, or arranging an inspection date, they will be implictly admitting they have agreed to your tenancy ending.0 -

Thank you. I have actually just found an email from the landlord (dated Dec 11th) which says:As you are in the last three weeks of occupancy (having given notice on the 7th December 2010 to vacate the property by 6th January 2011)
He is still saying that the gave notice on the 7th, but does seem to clearly say that we are in the last 3 weeks of the tenancy.
I wonder if that is sufficient.
EDIT: I also had quite a long chat with a very helpful lady from Shelter. I explained the situation, including all the key points I think (periodic tenancy, paid monthly, AST started on 7th, gave notice by email during the evening of the 6th December to vacate 6th January, got a response by email on the morning of the 7th).
She consulted quite extensively with her colleagues and the response I got was that I should be fine to vacate on the 6th. She said that it had to be a month form either the last day of the previous period or the first day of the next. She did say that email as a method hasn't been confirmed by case law, but that there was no reason to think it shouldn't be fine.
I am still a bit sceptical, but I am hoping that the email from the LL above is sufficient.0 -
