Hmmm try not to let it spoil xmas, I'm not. I would imagine they will be *snowed under* (no pun intended :) )as it seems to be happening to a lot of ex B/R's judging from the posts today

    Hi

My husband has just received a P800 Tax calculation from HMRC through the post, which states he has underpaid tax for tax year 2009-2010 and owes them £746. They say they will collect the underpayment from April 2011 through his tax code over 12 months.

We went BR in August 2009 and he paid a Nil Tax IPA for 3 months Jan/Feb/March 2010, which roughly equals the amount above.

Could this calculation be wrong and related to the fact he paid the Nil tax IPA? Or could it be a totally separate matter?

As far as we know he has always been on the correct tax code and it just seems like too much of a coincidence? Help please :o

    UPDATE GOOD NEWS :)

This letter arrived from HMRC today:

"We wrote to you on 24 Nov 2010 setting out your tax calculations for the tax years 2008-09 and 2009-10 and the adjustment to your tax code for 2011/12. We should have looked at the tax calculations before they were sent but we did not do this.

I have now looked at your tax calculations and have found that the information that we sent you was incorrect.

I am writing to tell you that I am very sorry for this mistake. On 24 Nov 2010 we sent to you tax calculations showing that you owed £746 for the tax years 2008-09 and 2009-10. I have now looked at the calculations. As you have a Bankruptcy Order in place we shopuld not have sent these calculations. We will contact you and the Official Receiver as soon as we can to tell you of your correct tax position."

We can breathe a sigh of relief now, however are still wondering if the tax overpayment my DH is supposed to have made of approx £200 for yr 08-09 will be refunded to him or not? The letter doesnt mention that!

At least its good news we don't owe them anything :)

Not so good news in the post  but got it sorted.

Sat am a letter arrives from HMRC informing DH of new tax code for the tax year 11/12 which has been lowered to include the underpayment from the year of his BR !!!!! This is despite having a letter from them which admits their mistake, as in above post!

Rang the tax ofice, waited nigh on 30 mins on hold, then got passed to a technical adviser who then read the notes on DH's file and admitted that new tax code has been sent out in error, and should be 747L not 472L. Another apology and was told it will be sorted

Sorry to hear that AP, but hopefully they will get it right this time.

Once you have the correct tax code that might be the time to approach them about the overpayment, maybe in writing though eh?

Thank you, just thought Id update as Im sure others are getting tax notifications through at the moment and its something to be aware of.

As for the underpayment from the year before BR, I think we had resigned ourselves to not getting it but as you say would be worth a letter maybe.

Yep, I was thinking a letter because it's less cost on the phone and stress for you both. You just send it off and whatever happens, happens.

    Good luck anyway.
