The thing about bankrupcy is is that often it doesn't actually help the DCA at all, especially if you have no assets. A CCJ is better for them as at least they will get something.[strike]-£20,000[/strike] 0!0

I realy don't agree with DCA's pushing ahead with bankruptcy if it means a family losing their home.
To be honest the family home is an asset that they should not be able to touch.0 -

That is great... Im a great campaigner about how VILE DCA's can be and I have no worries in denouncing them at all.....
bankruptcy is a Very Very hard decision and should only be made by people who really need it.

My favourite one is telling them I had found religion and quoted the bible down the phone.
For some reason they weren't impressed with me offering redemption and put the phone down.

Glad to see that you are back on form after that recent episode.
I was aware of this thread, but had to take a day off, for my br, so have not been able to add my twopennorth until now:
Firstly, the advice you have given is absolutely spot on. DCA's seem to rely almost totally on the fact that the people with whom they are dealing are ignorant of their rights. I do, often, also wonder if the 'front-line' people, in the DCA, are equally ignorant of the debtor's rights. If not, then surely it is doubly wrong for them to conduct their 'business' in this despicable manner. This view is re-inforced by the arrogant attitude of certain posters, on this forum, who, by their own admission are linked into this 'legalised mafia'.
I do not, for one moment, doubt that his forum is obligatory reading for the majority of DCAs and that they will be less than enthralled on reading your thread. I just hope that they take notice of what you say.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Thank you so much for this thread.
I've just had a really upsetting conversation with a horrible bully of a woman and ended up agreeing to make payments which were too high.
She said some really horrible things, that I was using the bank's money to set up my business and how cheeky it is that I'm not paying it back. This was without knowing anything about my situation (if she did know, she would know that this is not the case at all). I would normally have told her where to go, but I totally lost it.
These people are either very well trained in how to break people down, or are just naturally unsympathetic and horrible. How do they live with themselves!
I'm now inspired to write a letter to them telling them to take my offer or take me to court.
Just one question though: the DCA mentioned that I would be liable for all the court fees - is this true?

Hi Louisa,
another scare tactic. If they take you to court, you may end up paying fees, but this is again taken as a small weekly/monthly sum. However, if you go represent yourself in court, tell the judge how bullying they have been towards you, then most of the time the fees are waived.
