This part has me confused. If your friend has been a T there for 3 months why has she only "just got access to the post box"? If she was having her post re-directed from a former address that would make not a jot of difference to post addressed to the occupier at the rental property.
There was no key for the post box of the property. This wasnt thought to be a problem beause all the post was being re-directed from her previous property to her mums. (I think was the important bit I left out) So she didnt worry to much about access to the post box. it wasnt until someone else pointed out that the letter box could be opened by less official means that we found all of the post concerned.Debt free since July 2013! Woo hoo! The bank actually laughed when I said I have come in to cancel my overdraft.0 -
The Mortgage Repossessions (Protection of Tenants) Act, which came into force recently, requires that Ts are given a min period of 2 months notice. The Possession Order *can* be suspended by the Courts to allow the T that two months.
No harm in quoting this back to the lenders along with a copy of the tenancy agreement. Its new legislation, so they may not have met it before. Note its min 2 months notice, not 2 months from repossession. I would have thought the lender would still want to repossess in order to take control of that 2 months rent money and to ensure they get repossession after the 2 months notice period.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. ok, alternative rental property is no longer available.
what we are looking at doing is the following,
a) trying to find somewhere suitable to move in to before 15th December
b) Applying to court for the 2 months to find somewhere else to live. But I am still not sure if we can do this because the court case has already taken place. I will see if I can find someone to ring, as I have tried to phone Shelter about 15 times already this morning. I wish I could find the answers without taking up their obvioulsy precious time.

Yerh probably Im only in my 20's! :rotfl:Im having quite a stressful time in all this, I had to just phone my mum and tell that she would not be going on a jolly to the shops after work with my auntie and watching the TV, but that this is a serious matter and they need to sort it out now!Debt free since July 2013!
