Is FIRE stupid ???

Hi,
I recently (last thur) sent a template letter to FIRE (a DCA based in Bradford) asking for a copy of the credit agreement. FIRE are acting on behalf of CABOT who I suspect have bought the debt from MBNA. I enclosed a £1 coin with the letter as the information costs a pound so I understand.
This morning I recieved a reply from FIRE thanking me for the payment which "shows a willingness to repay the amount owed to MBNA" !!
I cannot believe they have been so stupid - unless there is some method in their madness?!
Please advise!!

Just send them another letter stating what the amount was meant for and thats if they do not reply within x amount of days (I think it is 40 days for a DPA request)! Plus remind them how much time they have left before you report them to the FSA and Information Comissioner.
Plus reiterate it is not your debt until they prove it.
Don't forget to send them the letter by recorded delivery.

it's very simple. by 'accepting' the £1 they are sneakily trying to prevent a debt being statue barred by time limit - restarting the clock, as it were.0

It said that I request a copy of the credit agreement under the credit act and that I understand that the debt cannot be enforced unless they supply it.0 -

With reference to the above agreement, we would be grateful if you would send us a copy of this credit agreement.
We understand that under the Consumer Credit Act 1974 (Sections 77−79), we are entitled to receive a copy of our credit agreement on request. We enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act.
We understand a copy of our credit agreement should be supplied within 12 working days.
We understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.
We look forward to hearing from you.

I think they are just chancing it and hoping you just say 'oh well'- but definitely do not!! make sure you re-iterate what the £1 was for and it wasn't an acceptance of any debt they say they hold over you!0
