Scratches and Damage to Item

I recently purchase a used sonyPSP game console for kids for christmas, auction stated it had been used once and is in excellent condition.
I dont expect the item to be mint but there are scratches on the screen and scratches to the rear and I would say it had light use but over several weeks or months.
What are my rights ?
I would be happy to keep the unit but am dissapointed with the price I paid and would like a partial refund.
seller just ignores all email.

I think you need to start an item not as described dispute on ebay.0

What damage or condition would you say is acceptable for an item that was in auction described as "used once"0

I would say used once means just that.
Does the item still work? The item works ok, just feel the description is misleading "not as described" I opened a dispute and will cross my fingers0
