Parking Suspended

hi there,

just an opinion needed from a few of you if thats ok.

i recently got a penalty charge notice for parking in a suspended bay.

My beef is that there is only ticket machine on this road and though there were 9 bays on the road, all were suspended apparently by one sign which was hoisted 6 or 7 feet high on a lampost which of course I didnt notice.

My question is this. The ticket machine allowed me to buy a ticket for the space on the road, (along with at least 4 or 5 other drivers) with no notice at all on the meter and so we obviously all just missed the suspension. Why were we allowed to buy a ticket in the first place ?

Secondly, the fine is £100 for an outer london borough but is this counted as a serious offence ???

    Please post on pepipoo forums, register and once you are cleared to post, start a new thread with a scan of the PCN front and back, all the small-print. Do you have a picture of the bay and signs, including the suspension sign? Post them there as well on your pepipoo thread, here's a direct link to the right board for your case:

    See the FAQs and stickies at the top of the pepipoo forum board for how to post images on your thread, just blank off ID details and PCN number but leave all dates, location and all small print on show.

    There is usually a solid point of appeal immediately in these cases, and there could well be others which will become apparent when the experts on pepipoo see your paperwork. The first point is likely to be that the suspension signs are probably not in a prescribed format (typically people post pics of a rubbishy white A4 sheet stuck on a yellow cardboard sign, which is an unauthorised sign in most cases).

    And you can also argue of course that the sign was not clearly visible in the bay where you parked - put the Council to proof as to when the signs were put there, where they were placed and what notice was given locally, if any. Was there a temporary traffic order in place?

    But first things first, pepipoo posters need to see the paperwork for them to help you with the wording of your appeal. MSE is not the best forum for this as we have less expertise.

    I should add that the VAST MAJORITY of Council PCNs on pepipoo are appealed successfully.

    Your best bet would be to post about your case on pepipoo forums, start a new thread there including a scan or pic of the front and back of the PCN (just blank out car ID and PCN number). Include pictures of the bays, signs and the suspension sign itself. Suspension signs rarely conform to the regulations and Pepipoo are the experts.

    Yes but if the parking bays are suspended, the council would know as they were the ones doing so, it begs the question why were the meters on, why wasn't notices placed on the machine ?

    So on the above, wouldn't the council be liable for taking payment without providing the service ?
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?
