Car Accident Liability Dispute

Hi, All

I am looking for some advice as I am in dispute with my insurace company after they stated that my recent car accident was my fault.

The accident happened when I turned a blind corner only to see infront of me to cars that had a head on collission minutes before I reached the corner. The vehicles were blocking both carrigeways and one of the drivers was stood out of his vehicle in the oncoming carraige way. I travelling at approx 30 mph on the unlit road which had some light snow on it. I braked but in trying to avoid the driver in the road I slid into the near side verge of the road which caused my car to tip onto the drivers side and slide into the rear of the stationary car from the previous accident.

My insurance company have stated I am liable as the other cars could not be classed as neglegent as they had no chance in moving these cars before I collided with them.

At the scene the driver of the car travelling in the same direction as me stated that as he came around the corner he slid across the road and collided with the oncoming car.

It certainly feels harsh to have to accept liability for and accident just for being in the wrong place at the wrong time.

Can anybody give me any advice or direction as to how to proceed with my dispute.

    You can appeal their ruling, though from what you say here it looks down to your fault.

    Not what you'll want to hear but there is no-one else who could even remotely be considered responsible.

    Accidents are just that an accident it doesnt always follow that someone else was to blame. From your description the only person who could be considered negligent was you - albeit wrong place wrong time, but anticipating the road, stopping distance, skidding etc are all your responsibility.

    Unless the Insurers can recover their costs from a negligent party (and i assume you dont want to reimburse them) they will treat it as a "fault" accident and you will lose some of your no claims discount, because you claimed.

    Sorry if it sounds harsh but in this age of no win no fee a lot of people have lost of the fact that "accidents happen", and are always trying to find an "angle" to blame someone else (and i'm not suggesting this is what you are doing, i'm speaking generally).

    In essence be grateful you werent injured, put it down to experience and learn from it and move on.

    Big black mark for going to fast for the conditions, big gold star for avoiding the other driver. Sadly I suspect only the black mark is going to be taken into account by the insurance companies.
