Rogue letting agent?

I am having difficulty getting TDL Homes Letting Agency Glasgow to refund a deposit although the owner of the property has notified them that the house is in order and the the full deposit should have been made on 12/11/10. Any advice?

Which deposit scheme is it held with? You should get in touch with them, with a potential for raising a dispute.

  • There are no deposit-protection schemes in Scottishland.

OP, ask your landlord IN WRITING to instruct the agents to refund your deposit asap.
  • Ultimately the LL is responsible for the deposit AFAIK. If the letting agent will not return it then it is up to the LL to return it to you and then chase them for the money. Put it in writing to both the LA and the LL that you want the deposit returned within a specific time frame.

The landlord has spoken to a solicitor and copied me his written request. He says that he will refund my money if his request is denied againand take TDL through a small claims action

There's a recent entry on the sheriff court listing for 17 Jan or 18 Jan by someone taking this company to court (case SA4582/10). Couldn't find any published judgements, perhaps they don't publish the outcome if it's a small claims case.

Also, there are other negative posts here about TDL homes and their practice of not returning deposits stretching back a couple of years.
