What should we do????

We have sold our flat subject to contract on the 21st July.... We have still not completed after various issues with the buyer. He is now having problems with his lender who are asking for amendments to be done to our lease... my solictor is refusing as the lease was complety rewritten in April of this year.

Our problem now is, we have moved to scotland, and are having to pay the mortgage and also the rent on our property here.

We don't really want the buyer to back out as we really need to sell, but we do kind of feel that he knows that and is using it against us..... (this is not the only problem we have had)

Should we become firm and state that we are going to remarket the property if we do not have an answer by the end of the week? We have been awaiting a response from his lender for over two weeks now.....

Any advice would be great, I am beginning to get really ill over it all.....

    You can only put up with so much. The soliceter cant refuse unless those are the instructions that you have given him, how much will it cost you to get the lease changed? If its wiable and you are prepared to meet this cost then consider it, it could take a long time to resell and you will be occuring costs from the mortgage.

    Why does the buyer want these amendments and what are they.

    These are the decisions that you need to make first, if the amendment price is less than the mortgage payments and extra sol costs to start from scratch, I would go with it as although its not fair, its better than cutting your nose of to spite your face sort of thing.

  • At the minute the solictor is saying that they are asking for amendments for the sake of it.... we have offered to pay but they are still point blank refusing to change anything.

    My solictor is in a meeting with the buyers at the minute.... fingers crossed.

    What makes it more difficult is my solictor is not so good at communication.... I have to email her every day...
