Indemnity Insurance - Land

Hi
Can anyone advise on the following:
We bought our house 'off plan' in Jan 05 and moved in in June 05. In Sept 05 we received notification from Land Registry of confirmation of title and noticed that the rear garden was not included. After investigation we found that it was covered by an indemnity insurance, obviously we were extremely annoyed with our solicitors for the oversight and of not being informed during the purchase process and managed to recoup a small amonut of money through the law society.
My question is, is there a point in time where we can apply for the land to be transferred to our title and what is the process for this?

WHAT was covered by the insurance?
Did you not check the plans showing what you were buying?

I believe that there is a process whereby you can claim land as yours if a) no one else claims they own it and b) you've been using it as though it were yours for a period of time. I believe it is 12 years but I'm sure someone more knowledgable will come along and explain it better...0

The garden is covered by the insurance and not included within our title.
Yes we did check all the plans and believed that all the land was included in the property. There was absolutely nothing to suggest otherwise.
It was not until 3 months after we moved in that the matter came to light. We had a long battle with our solicitors regarding the matter as I assumed they should have known this at the point of exchange of contacts and informed us. This ended with a complaint via the Law Society that resulted in a small sum of money returned. We were informed that for all intense and purpose the land is ours and that it it not uncommon, especially with new builds.
I am led to believe it is unknown who owns the land, hence the imdemnity insurance.

take legal advice, most lawyers will comemnt at a quick meeting.
don't you do anything as you could invalidate the insurance by apporaching the Land Registry or any neighbour.My posts are just my opinions and are not offered as legal advice - though I consider them darn fine opinions none the less.:cool2:
