Obligation to return item sent in error?

    I'd contact them and tell them that you have been using the camera as you thought it was a substitution. Tell them that you have no intention of paying any more money as this was their fault.

    You can also say that you will make it available for them to collect on a mutually agreeable time as long as they realise that it has been used. I would also insist that the one you ordered was brought at the same time.

  • I've no idea if it is in their terms which is why I stated that a substitute item is only allowed if the stipulation was made before the purchase.
    I've never used Tesco direct before, but there may be something on their checkout page about this, if not, there is a bit in their conditions which states

    "We have taken care to describe and show items as accurately as possible. Despite this, slight variations in items may occur."

    so they are stating that the delivered item may differ from what you ordered, so this may well be good enough as a disclaimer.

    No way will that be good enough as a disclaimer!
  • Thank you to everyone for your replies. I particularly liked Takoda’s suggestion! The Tesco representative did say that they would arrange collection so no cost there but only mentioned a refund not a replacement so that is something to investigate.
    I asked what would happen to the camera and was told that it would be sold as “used” with a discount of around £20.
    I have already told them truthfully that I still have the camera and that other than charging the battery it has not been used. Tesco is lucky that it was destined to be for Christmas and not for a more immediate birthday as we have had it about four weeks now. In the circumstances I will of course make it available for collection. I just wanted to know where I stood.

    End of the day big stores try their hardest to screw customers, so in my book at little pay back is fine.

    If they collect it from you they will wait until they have it back then you will go into the long wait for your mnney back. When you eventually get it they will not include the P&P, so you will have to contact them again on their premium number and fight to get that.

    Just make sure you give it to them back on your terms not theirs

    They sometimes sell reconditioned items on the website, so this may well be where the camera will end up.

    If they want it, they may collect it. You are not obliged to rectify their mistake at your expense. Odds on, they won't bother.
