Good morning everyone, some of you may have read yesterday that I have been placed into the work related group of ESA i have some backdated money due to me.I have recieved a letter today detailing how much I will be getting now,it then goes on to say that they haven't issued the backdated payment as I have a dwp overpayment that I am currently paying off weekly as agreed, and they are looking into whether they can use the backpayment against the overpayment.I am quite cross about this as we already have an arrangement in place to recover the overpayment. Is there anyway I can prevent this as really would like a mobility scooter to make my getting round a bit easier for me thus giving back some of my independance?

They can offset the overpayment against the arrears if they cover the same period. They'll have a special overpayment team in your benefit delivery centre. You might want to contact them to establish the periods involved & whether they're going to offset, partially offset or release all the arrears to you.
Their objective is to recover the overpayment as soon as possible. If that means not paying your back money then, yes, they can do that.I no longer contribute to the Benefits & Tax Credits forum.0 -
