i suspect it would be decided as contrived as you were not renting it out for the period that you owned it solely or the period prior to your brother moving in, he is not currently paying rent is he, so for you to start charging rent now and then him claiming benefits for it, seems contrived (although that may not be your intention)

i would help him find accommodation elsewhere and get some income from the property
