Repair under Distance Selling Regulations

I am confused by this - your TomTom is still in warranty - so deal with them - they should either replace, refund or repair - much quicker than going back to Pixmania ....
You are probably right, I'm just used to other companies where warranty hasn't been an issue. It breaks, they fix it, endof. But not so Pixmania.
At 11 months my cynicism perks up when the company that sold it to me ducks their responsibility - what happens if I spend a month negotiating with TomTom (who I have never had any dealings with), and get passed back to Pixmania outside the warranty period?
Anyway I'm sitting waiting for Tomtom now. With Kind Regards

Just delete the spammers? It's not difficult (I have a phpBB forum & I get spammers too, but I don't pass my pain on to my users like this place).
This "Top Ten" website is 51 in the UK & 1544 worldwide. I'm not knocking it, just letting the pedant inside me have free rein.
Ah fair enough about the stats, I'm sure it is top ten in something but it could be a sub catergory.
I would guess Martin feels that deterrance is better than trying to mop everything up and with tens of thousands of users his team have better things to do than having to delete lots of spammers.
Consequently we get very few spammers on these forums. The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!
If I give you advice it is only a view and always always take professional advice before acting!!!

You are right about DSR - I quoted the wrong law. But they ARE responsible under the sale of goods act? I'd link to it in a sensible Forum - what idiot set this one up?
I'm in the UK, bought the goods from the UK, with a UK Bank Account, had them delivered to the UK. What has French Law got to do with anything? See these links ....... (more idiocy)
Anyway, it seems that according to some EU legislation published in 1999, since 2002 it has become a legal requirement that all consumer goods sold in the EU must have a minimum of a 2 year warranty.
So from what I understand, if something breaks within 2 years and the retailer or manufacturer claim that there is only a 1 year warranty, you just need to quote Article 5 of the EU Product Warranty Directive (1999):
See these links ....... (more idiocy)
 Are you trolling?
Are you a Daily Mail Reader?
I have to ask these questions as the answers to them might make things slightly clearer.
The SOGA supersedes the secret 2 year warranty, that means that if you want to get the seller to do something about it you will have to get an independent engineers report proving that there is an inherent fault.
Pixmania are a French Company, thats what French Law has to do with it, at the moment you have no reason to operate a chargeback on your credit card. What Runaround have you gotten from them? They have told you to go to TomTom, perhaps in this instance going direct to TomTom would be a good idea. I work for a large retailer and any time someone comes to us with a faulty TomTom or Garmin, we either let the customer call or we call them, they're usually quicker contacting them themselves however, TomTom will take in a repair and process it quickly and Garmin will replace it.
I'd recommend that you just contact TomTom and get it sorted before your manufacturers warranty runs out and you have to pay for an independent engineers report.0

I think the point about the EU Directive is that all members of the EU should have implemented a SOGA-like law. What that law is in France, I have no idea.
OP, you are going to have a struggle as it will be French law that applies. Perils of dealing with Pixmania, I'm afraid.0
