Months notice over Christmas

Right, our mortgage offer should be here in the next couple of days so we're giving notice tomorrow. So what do we do, do we vacate on the 30th december even if they're closed or what?

I know I could ask them but they'll more than likely say something to make their lives easier. I've put in the letter if they can get someone in before christmas then crack on.

Anyone know?

    As long as you give a full month from your rent payment date then that's the date. No reason they should be closed on 30th Dec is there?.

    Have you asked your solicitor whether that is a sensible thing to do?

    What happens if the seller turns round and decides not sell for some family/personal reason or if there is a chain there is some delay further up the chain?

    Nothing is certain until contracts are exchanged. So we always advise clients never to give notice on their rented until then.

  • Hi, There is a two person chain, with us being FTB. My OH is going to see the solicitor tomorrow to see if he thinks it's ok aswell but I'm just writing the letter now so that if he says yes then we can give notice that day. :) Just being prepared. Also the people above us want to move by the 13th (Yes I know, fat chance of that happening but let them dream I suppose)

    Oh and if things do go pear shaped we always have my parents farm we can crash at :)

    (The following is all assuming that you're in England & Wales and that you're on a periodic contract.)

    Beware that just because you give notice tomorrow that doesn't mean that you only have to pay rent until December 30th. It all depends on your tenancy dates. Usually these coincide with your rent due date, but not always so check your contract. For example, if your contract started on the 30th of one month and you are out of the fixed period and on a rolling, periodic contract, then you can indeed give notice on November 30th. You would then have to vacate the property on December 29th. If you stay an additional day you'll be liable for another month's rent.

    If, on the other hand, your tenancy started on a date other than the 30th then it looks different again. If you moved in on, say, the 15th of one month, then your next opportunity to give notice would be December 15th, to vacate the property on January 14th.

    Incidentally, if you moved in on the 1st, then I believe you could give notice per the 31st of December but I'm not actually sure if it's even possible to give notice to leave on the 30th of December (someone else will know more)! (edited to add that of course you can agree with your LL to surrender the property on any day that is mutually convenient, but I don't know if it's possible contractually to give notice per the 30th of a month when the previous month only has 30 days)

    We were FTB with no chain - had mortgage offer in July and hoped to complete in Sept. Just completed last week and given in one month's rental notice this week. I wouldn't give your notice in until you exchange. Although you say you have a place to stay meantime so that could be ok but bear in mind, if things fall through for any reason, you could end up staying there 6 months. Good luck.

    I'd still be wary of handing in your notice before exchanging OP. I'm in the same position with renting and I'm not handing in my notice until exchange. You might think that things are ok but I've been trying to exhange on my property for the past week and things keep cropping up. We had intended to exchange with a view to completing this Friday but thats looking unlikely now. I'm getting a bit stressed as I pay rent on the 2nd so need to exchange by this Thursday at the latest so I can hand my notice in. But the latest reason for not exchanging is a biggie so no way am I doing it. The issue is with the sellers and there was no way for me to know about this issue until an attempt at exchange was made. So I think it's wise for to wait. You don't know what might be lurking around the corner.
